As a judge, I do not write the laws. I didn't say that I agree with the law. I merely stated the status of the employer/employee relationship under the laws passed by the Ohio legislature. It was certainly not my intention to indicate approval or disapproval of the specific law in question nor to request personal abuse because you apparently hold judges in low regard.
Sir. I hope i am not putting you on a spot, but i am curious. if you can't or won't answer my question that is more than fair.
my question, as a sitting Judge( assuming you are sitting) when faced with a law that is clearly unconstitutional, yet passed by a body of partisans, do you uphold that illegal law or work your way around it so to speak?

The only so-called law enforcement agencies that I hold in high regard is most of the Sheriff's office's in this Country as they adhere to the Constitution Of these United States. So as far as liberal judges, police departments, HLS, FBI, BATFE, CIA, NSA, corruption runs rampant. When anyone can in clear conscience uphold a so-called law, where an employer cannot be held liable for causing the death of an employee, that is worthless. IMHO! After this I'll just ignore! Today's judges and law enforcement other than the S.O., interpret law along PARTY LINE instead of Constitutional Law!

Living in Utah now, but will retire in April '22. We bought mountain property between Ashton and Island Park near Mesa Falls on the Warm River. Will build our retirement home there and live out our lives in the mountains that I love so much. Looking forward to muzzleloader hunting with my Leman rifle and doing lots of fly fishing. Also, I have a high school buddy who lives in Sandpoint and catches LOTS of big rainbows in the lakes up that way. He's already invited me up for a week long fishing trip. Can't wait!!!
Hello neighbor, Ashton Reservoir is where the state record 27 pound brown trout was caught a few years ago. The town of Ashton is friendly, has most of your necessities and Rexburg is 25 mile down the road. Rexburg has the big Walmart, Harbor Freight, Cal Ranch, and BYU Idaho. But you probably already know that. If you have any questions, feel free to pm me. Forgot, Island park is the 2nd largest snowmobile area in the West, and St. Anthony has the Sand Dunes that give you miles and miles of four wheeler enjoyment.

Thank you for your courteous question. I have not been put in the position to rule on the constitutionality of a statute because no litigant has raised such an issue in my court. I am a sitting judge in a small, rural and very conservative community and while it is possible that some conservative, constitutionalist organization my try to forum shop to get something of that nature in front of me, it is not likely. I was the Tea Party candidate for Attorney General in my state in 2010 and live in the most conservative appellate district in my state. Typically, but not always, constitutional challenges go to more urban courts where the appellate rulings have a tendency to carry more clout with the state supreme court. I would not hesitate to declare a law unconstitutional, however that ruling could be overridden by my court of appeals, the state supreme court or , depending on the issue, a federal court. As a trial level judge, I was put here by vote of my community, where I am well known as a former atty for the NRA and American Center For Law and Justice (conservative, Christian answer to the ACLU). Trial judges are the lowest level and are almost always appealed by the losing side on constitutional issues. Thank you for being courteous and not assuming that this born dirt poor, worked my way through 7 years of college, starved for years building my own business, became successful enough to want to give back to my community, Christian, conservative father of a captain in the U.S. Army should not be treated like an enemy of the state, the people or the constitution because I chose a profession and position where I could try to counter some of the things another member of this forum has accused me of being just because of the title that I hold.

A redneck is a person who fits all or most of Jeff Foxworthy's criteria. Uneducated small town boy, with an outside view of the world that stops at the city limit signs. Usually a self-appointed expert on most anything that doesn't require any research or reading, which is difficult. A man who has not furthered himself through self-education enough to have any hope of self government. Loves to 4WD, drink beer, and act like a friggin' idiot at everyone else's expense. I could go on.

Having spent 15 years in the Idaho legislature & in local government & board member of a statewide citizens property rights organization fighting Forced Annexation. We learned first hand that all of the above agencies you mentioned are under control of the lobbyist Cartel comprised of developers, realtor's assn. & building contractors assn.
Years of correspondence reflected many other states have similar corruption issues of property rights theft & taxation without representation where taxpayer dollars are being used to subsidize the private ventures of Cartel members.. the Cartel's coffers select & elect those who will sell their seats, Representative Government has been replaced with political prostitutes.
Perhaps one day Citizens will muster the courage to assume their lawful & constitutional obligation to arrest & oust rogue public servants who's actions & records validate they have violated their Oath of Office employment contacts & restore representative government. If not,,, we have what we deserve.
They won’t support us but the law says we have a right to challenge them in court against rich man lawyers. Corrupt isn’t the word for it. They are ugly excuses for human beings.
 
The country is kind of going over to the "moneyed". The thing is, though, with 28 trillion in debt, there really aren't any moneyed. We have people making untold thousands because our government keeps printing money out of thin air. My property has evaluated a great deal, and my 401k has evaluated a great deal. If somebody calls in the markers it is imaginary money that will disappear in a puff of smoke. There is no such thing as "owing yourselves" by the way. That is called financing your future away. My wife and I live differently. We live within our means and we keep everything paid off. We carry no credit card balances. Still the government pulls us into their money madness, and probably, come the crash, and we will not fare much better than others. Why does our government run such irresponsible risks, when they do not need to? We should be firmly in the black, and the world should owe us. That is what superpowers do.

I know of what I speak. I was one of these individuals for several years until I sobered up and grew up.
 
The thing is, our country is in trouble. While I was spending my youth pointlessly, my country was being taken over by individuals who either mean it harm, or were too silly to realize what was going on. IMO Her salvation is in the hands of us older citizens, if she is to be salvaged at all. Too long I have sat by watching this happen, and my values and beliefs are being trampled into oblivion. America was a GREAT country, I remember her well.

Wrong......completely. Rednecks are not all drunks or uneducated. That's like saying all blacks are welfare recipients. There is good and bad in all races....but ignorant people are the ones that put labels on them! Glad you sobered up, now get educated.

Very well spoken my friend. You and I may differ on rednecks, but we agree on what really counts in this world! Even though I never met you, I'll consider you always a friend, as friends can differ and still be friends.

I've always like Thomas Sowell's description of a redneck. That description includes poverty, violent boisterous behavior, touchy pride, disdain of education, loud proclamations of a religion that doesn't seem to reach into their personal lives, ect. Take what you will from it but he argues that it crosses ethnic lines and makes a persuasive argument that it normally ensures that the person that fits this description will be disadvantaged. His book black rednecks and white liberals is a very thought provoking collection of essays about how the so-called black culture today is just a reflection of southern cracker/redneck culture that originated in a sub culture in Great Britain. A lot of what he says rings true and is applicable to the current covid debacle. It takes some huge leaps of logic to believe some of the conspiracy theories put out by some people. Samuel Clemens also explains how poor sub groups of people engage in self destructive behavior that ultimately benefits the ruling elites. In the book " A Connecticut Yankee in King Arthurs Court". Left or right, people with power have always hung onto the power by manipulating the poor. Poor black people act surprisingly similar to poor white people tho neither group is likely to admit to it. And furthermore would benefit in dropping their hostility and working together. Follow the power (money) and you'll see how it advantages the elite to have the common man at each others throats. It makes me cringe when I hear some of the BS that the right comes up with even though I would identify with that group. I was very uncomfortable with Trump somehow becoming the champion of poor whites. That was the most amazing deal he accomplished. He became a weapon of the elite right even though many of them were initially very uncomfortable with him. A roadside sign in Texas summed it up. Trump, not perfect but perfect for the job. Who was using who? Seemed to me it was like dealing with the devil. Democrats were against the vaccine until the power transfer. Now they are for it. Dont tell me the left and right groups aren't using this crisis to make political hay.

These are just my opinions and observations. I used to be a poor white boy whose formal education stopped at 8th grade and could of resembled some of those descriptors. What this has to do with Idaho i don't know. Just going with the drift.
