Many old caplocks were made that way to prevent loss of the cap while traveling. Would you want to draw down on an attacking NDN or bear and find that the cap was missing?

If that engagement isn't solid, return the gun for repair, replacement or refund.
Its possible that the nipple is to large for the caps to fit properly. Try another brand of caps, reduce the diameter of the nipple, or replace the nipple with one of smaller diameter and possibly one that is a little shorter.
If that doesn't take care of the problem, return it.
