Well, I have been through this process at Cabelas recently and can tell you exactly what transpired. About 6 weeks ago I bought a new Pietta 1851 Navy in .36 caliber here from my local Cabelas in Ft. Worth. The nice young fellow that pulled it out of the case for me shortly afterwards handed me a form laid out just like a 4473 but not the official form and on white paper and using a different font. I was told I would have to complete the form before I could purchase it and that is was kept for store records only. I made it quite clear that I was not happy about this since we all know muzzleloading firearms are exempt from federal regulation. Not only did I have to fill out the form I also had to have my ID scrutinzed by a "manager" comparing it to the information I had filled out on the form. I made my thoughts known to this manager who gave me a look that would suggest "Do you want the gun or not?". I also gave them my Texas issued LTC which didn't seem to matter. The only reason I chose to go through with the purchase after all of this was because when was the last time anyone saw a new Pietta for sale anywhere??? I'm not sure I will buy another BP gun from Cabela's because of this. I would say that anything other than minimum compliancee with the law is self regulation.
 
ATF DOES NOT REQUIRE 4473, no where in ATF rules does it state that BP has to have 4473 or a phone check, it does state that BP is exempted . Cabela's paper work is for their records ONLY As a dealer someone is blowing smoke Cabela's in Ct only requires one to fill out their paper work for their records of sale. AS one said if one does not like what one dealer wants go to another , there are a lot BP dealers out there.:doh:
Cabela's sold a muzzleloader to someone who wasn't supposed to have it by law, and that person used said gun in a murder. Cabela's was sued and lost.
Hence the new policy.

Cabela's is covering it's butt after being sued and violating Ohio law..

I few years ago I bought a firearm from Walmart. They demanded two form of address along with my ID. I wasn't happy about it and had to go out to my car to get the registration to show proof of address. I would have walked off but the gun was on clearance so I was getting a heck of a deal. Yes it wasn't a requirement for two forms of address but at the time it was their policy. This was close after they got burned for selling guns improperly.
 
Cabelas does NOT have legal authority to do this. So if someone wants to lie on cabelas paperwork, you can’t go after them. I think cabelas, wall mart, and others WANT to get out of the gun selling trade, and this is the preliminary step. And the part about store records only- sure, an ATF agent can “ accidentally “ look through them . I’d rather shop small business anyway, please support them. They need the money,to fight new rules meant to shut THEM down...
 
Cabelas is not a legal entity. The form they use is a different one than the ATF form. The ATF only has the one form. So any store generated “form” is not legally valid in court. I haven’t heard of the Cabelas police, or Cabelas judge convicting anyone recently.
 
You can lie to a store all you want. They are not a legal entity. Not on a non official form.
 
By the way my trapshooting lawyer buddy says cabelas has to follow STATE laws on selling muzzleloading guns, but any forms generated by cabelas are not legally binding, they are not a government.

Cabela's is attempting to comply with interstate laws. Lying is still illegal.
furthermore it opens you up to civil liability.
Remember, lies ore often considered evidence of guilt in court.
 
Interstate laws don’t apply to muzzleloading pistols or rifles. Except the ones we don’t like here.....😀

I guess that depends on a few factors, but lying on the form is a bad faith purchase, and lying shows you intent.
 
You can LIE all you want on a fake form made up by cabelas. But you can’t lie on the official ATF form 4473, as presented by a gun seller . Any “form” that is not a official government one is not valid.
