The BATFE classes BP rifles and revolvers as non firearms. That is how felons can own them as they are not allowed to own firearms.

In NH all you have to do is walk in, prove your 18 or older,pay your money and walk out with your new C&B gun. No background check required. No restrictions on shipping BP guns to NH either. As I said earlier, hopefully the bad guys won't catch on and ruin it for us law abiding folks. For now the antis have other goals although in Mass. NJ Ill. and a few other states they have succeeded in restricting BP guns.

here in PA also....as a matter of fact i've seen gun shops with a sign on the counter saying....no back ground checks for black powder gun sales....now if thats not advertising i don't know what is.......bob

No, actually in a lot of states a convicted felon CAN own a BP firearm. They can here in Oregon.

Here in Texas article 46.01 of the Texas state penal code states that (3) A "firearm" means any device designed, made, or adapted to expel a projectile by using the energy generated by an explosion or burning substance or any device readily converted for that use. Firearm does not include a firearm that may have as an integral part, a folding knife blade(??? a pocketknife pistol???) or other characteristics of weapons made illegal by this chapter.
included in the "not a firearm" section is....
(A) an antique or curio firearm manufactured before 1899; or
(B) a replica of an antique firearm manufactured before 1899, but only if the replica does NOT use rim fire or center fire cartriges.

I made a poor decision in my youth and drank heavily, none to say, I am now a not so proud of my past felon :shake:(three times a charm for DWI) and in the past year or so have gotten into hunting(bow hunting at the moment) and have been researching heavily on what I can and can NOT do here. Now not to say every felon should have the right but there are folks out there that ARE in there right minds with poor past judgments and there are folks out there that have no business whatsoever going near the hunting section in walmart :shocking:. I just hope I get the chance to legally hunt with a BP rifle someday(as soon as I finish all my research) before the cranks making our laws do something ugly :nono:

It seems that some of these laws are passed without the slighest idea of what they are enacting. Here in Oregon I have a concealed carry license. But that's only good for a firearm. If I carry a concealed hunting knife I become an instant felon. Someone please show me where there was an active brain cell figuring this one out.

I too am in the world of blackpowder because of a mishap. My wife and I are more happily married than any other time in our lives, but one night a few years back we had an argument and she called the police. I was charged with a 4th degree misdemeanor domestic violence (which my "lawyer" described as being like getting a parking ticket). I have read a decision from a judge who stated that this situation was "...equivalent to not being able to own a car or purchase gasoline because you ran a stop sign".
They asked her if there were any firearms in the house. They took everything I had, including BB guns and my bow! They specifically told her they were taking them temporarily "for safekeeping". They then kept me out of my own house for two months.She told the judge, her case worker, and everyone else that she wanted me back home. We love each other, always did, always will. At the end of those two months,I had a choice of going with a jury trial or pleading guilty right then and there. my wife and I decided it would be best if I just pleaded guilty, otherwise I would still not be allowed back home until after the trial, which could have taken more months. Even with her standing up for me, the prosecutor wouldn't budge off the DV charge even though other people I've talked to told me they received "menacing" charges in similar situations (which would have allowed me to retain my firearms).
It took me over a year and a half just to get back my bow, BB guns and blackpowder rifle. They still have about $4000 worth of fireaerms "in safekeeoing" including many items of mine I CAN legally own - gun cases,cleaning rods,slings,etc.
If you ever study this situation, you will find that the provision for those charged with misdemeanor DV not being allowed to own firearms was something most of our elected officials were NOT aware of when they passed the legislation in which this provision was included.
My wife wants me to be able to hunt and shoot - it's been a lifelong passion. If this had been a situation where someone was hopitalized or she was terrified and wanted a divorce, I could probably accept it, but this is not the case. Not for me, and I'll bet not for thousands of other men and women. They tell you you can apply to the BATF to have your rights restored. What they don't tell you is that Congress has failed to provide funds for this program, therefore the BATF takes no action whatsoever on your application. We need to keep blackpowder arms available to those of us in this situation.
Maybe you don't agree. Maybe you think one mistake like this is too much. Well,maybe you should ask my wife - she'll tell you the same thing I am.
 
That's because the people who instituted these laws against freedom think that anyone who owns a gun or hunts is an illiterate drunken lout who kicks his dogs, beats his wife and neglects his children. Admittedly such people exist and should be punished, but please, let's have some sense of sanity.

"Lawmakers" are not interested in making sense whatsoever. They are only interested in subjugating the serfs they have the audacity to call "citizens".

The more insane the laws, the better for them.

The only solution of this ugly situation: vote out EVERY politico after the first term. It might take 20 years till they learn to respect "citizens" again (if they ever did).

There was an item on tv about a month ago. It was about
the murder of a fellow in Okl. which happened some ten
years ago. He was out shooting a .36 Colt Navy, when
some strangers stopped and ask to shoot the "ole" gun.
He loaded and handed it over. They shot him with his
gun. They then pushed his body into the river.
Never hand a stranger your loaded gun. :nono:
