Is it one of those laws where you'd need a lawyer to interpret it? It sounds like it's going to be left up to the individual game warden or law enforcement officer to interpret this new law. There could be some "undesirable" consequences.
And that just the problem. Many Hunters and Gun Owners are well versed in the Gun Laws of their regions. On has to be. But it does not stop an over zealous officer and or Prosecutor from putting you though an expensive wringer just to find out you were right to begin with. They mostly have a well of money to do what they want wrong or right. Joe Citizen on the other hand feels the pinch...
 
So the 13th amendment has limitations, and the 19th also has limitations I guess your right NO amendment is absolute. BUT since the 2nd is the one and ONLY amendment that contains the sentence " SHALLNOT BE INFRINGED " And it can and is ignored, we can choose what any amendment can be followed or ignored or is it just the ones the gov doesn't like and I am by law required to follow what I am told to or be punished
It is all about the details. Regulation has been determined by the SCOTUS to not "Infringe " on your 2nd Amend rights. Period. There is no room for discussion. It has been decided many times. Hence GCA of 1968 and more. Done deal!
 
This is another one of those things like New York's safe act that will be fleshed out over time and after legal challenges. I believe that most law enforcement agencies here will be fairly reasonable about enforcement due to the ambiguity an obvious room for legal challenge. They handled the safe act that way.

I don't believe that is the Queen's intent, nor was that the intent of her party. They want rigid enforcement, despite another poorly written law.

I think the intent of NYS Governor is clear. They want ignore the SCOTUS ruling, will onl pay "lip service" to it, and will do everything possible to get around it.
 
Eutycus, the new laws read pretty clearly and I don’t see a lot of vagueness. With the exception of how I read the exemptions, which appear to mostly apply to law enforcement officials, it reads that persons engaged in legal hunting are exempt, I am not sure how. Citizens may get a different response than a law enforcement official when stopped.
 
Pass a knee-jerk dictatorial law.
Receive a negative responce from thoes negatively affected.
Claim law enforcement will most likely use discretion in enforcement.
Do you feel lucky? Have lots of cash for legal fees? Look forward to some hard time to catch up on your reading?
 
Look up New York Law S51001. It has all the new changes in green highlight. And redline deletions.
 
A lot of things going on in New York State. First, you have a very angry, and power-hungry Governor. There is no doubt that she has ambitions beyond being Governor of NY. The new firearms law actually got rolling after the mass murder in the Buffalo supermarket. Once the SCOTUS tossed out their handgun law, it pushed her over the deep end, and she acted out of emotion (anger) rather than reason. And because she has a democrat-controlled State legislature it was easy to ram-rod the law through.

It was the same with Roe v Wade. As soon as SCOTUS over-turned it, she again acted with emotion (anger) and signed laws protecting abortion in NYS. Fine. The SCOTUS simply overturned a bad decision and put it back on the States to decide.

SCOTUS is not real popular with democrats right now, even though they loved them when they upheld Obamacare, and made gay marriage lawful throughout the land. But now because they hate Trump, they hate the SCOTUS because he was able to place three justices on it. The anger also stems from McConnell effectively blocking Merritt Garland, which was a wise move since Garland proves every day why he was unfit for the SCOTUS.

Now like little children they act up, create accusations against nominees, make a scene, and cry that the court is illegitimate, illegal, radicalized, rogue, outdated, and we need to pack it to have "equity." Never mind that Schumer would have done exactly the same if he had the chance. And make no mistake, the attacks on Clarence Thomas are only beginning. His ouster is next or at least planned with their next agenda.

So, you are seeing not just the Governor of New York but democrat Governors of other States acting out because they are upset that a decision did not go their way. The political divide has also spread to judges at various levels, many of whom on either side now make rulings or block things based on their political view rather than how the law is written. Yeah, I know what the law says, but I think it should say this. Or an outside lobby works to find the right sympathetic judge to block or stop something. That is where we are today.

The political ideology, anger and divide runs deep. It is affecting everything, not just firearms laws.

The best and most patriotic thing you can do this November is vote against every single democrat on your ballot, right down to school board members. And do that in-person on Election Day. Avoid early and absentee voting. JMHO.

In 2017 I wrote a article on a Safe Act arrest in Ft Edward NY .posted in NY firearm forum and sited in the Long Island firearm forum .The police chief DA investigator and the Deputy DA were all interviewed and cited. In a nutshell the safe act says if the magazine is "fixed" and not removable some features would be allowed if removable then all safe act rules applied and in some cases against the law. The DA stated and I quote " The AR was designed and intended to use a detachable magazine and unless it's permanently welded to the lower there is no other fix and I will prosecute every case brought to me" unquote The law says one the DA says another, permanently is implied in the law not defined.So our new gun laws may or may not include muzzle loaders but when enforcement is discretionary on the part of law enforcement an over bearing zealous DA will always put you thru the grinder .

Are you crazy? Do you want everything you own destroyed? Your wife and children killed or refugees? Are you really ready to rebel? It's easy to talk the talk, but I will ask again: How'd that work out the last time?

Only really answer lies with new Yorkers... The rest of us can just boycott the state.
 
If it is hidden ,how would anyone know? And to search would that not require a search warrant ? And exactly what would you be doing other than robbing a bank to get that level of attention? Or just tell them you just crossed the border and wanted sanctuary and they will send you on a fancy vacation all expenses paid by the folks already

Searching a car is not subject to the same requirements as a house. A car is mobile and likely to be moved. There are slightly less restrictive rules for searches of cars and even fewer restrictions to frisk an individual. Each state differs slightly on what was allowed, but the SCOTUS has spoken on this several times.
 
The only way you are going to get better and common sense answers, is to get people to realize that politicians and media are using them, and pitting them against each other with lies!
I think many people understand that the govt, politicians, media have their own agenda. I believe the problems is, the "people" do not really know what they best thing is, to counter that issue.
