I had a guy TEACHING a kid to shoot .22 lr and he shot in our direction. I called cops, long story short he was known by the po po and they said they would be happy to charge him but would also arrest me for battery. Seems when I walked over to his car and "touched it" to lower the gate and photo his license plate I may have said KMA or the likes and had ahold of my .32 rifle. I guess if ya tell an idiot to KMA ya cant have an unloaded ML in yer hand. THATS WHY I ONLY SHOOT IN THE WOODS (mostly alone).

Arrest you for simply telling someone to kiss your butt? All because you had an empty rifle in you hand? Sounds like an overzealous cop or maybe he was friends with the perp. Id report that cop to his superiors.
 
Criminal Battery according to the web is:

Definition. 1. In criminal law, this is a physical act that results in harmful or offensive contact with another person without that person's consent.

Because no actual physical act was made, I don't think that "battery" would have been a reason for an arrest.

Now, "assault" is another matter.

"The definition of assault varies by jurisdiction, but is generally defined as intentionally putting another person in reasonable apprehension of an imminent harmful or offensive contact. Physical injury is not required."

Because azmntman had a weapon in his hands while he made his comment I think a case for criminal assault could have been charged.

Bottom line is if you are armed, be careful of what you say to others.
 
Been long time, it may have been disorderly conduct? Not assault. AND YES THE A-HOLE was buddies with someone. Days later when they finally called me back it was "we spoke to "edgar" and he said..." I stopped the cop cold and said....Oh he's "Edgar" and Mr.___? Just tell me who he knows and I'll go away. Had to be high up....my pop was LE here for many years and knew the sheriff well, I was not able to get to the sheriff. I promise you one thing...had this occurred to ANY LE the way it did us the guy would have been grounded, cuffed and locked up (till who ever he knew got involved). It wasnt "right at us but about a 20 degree angle and a new shooter (kid). Ricochet? You guys know what kinda crap they have at these pits, wheels, fridges, stoves, pop machines not to mention rocks. It was felony endangerment at the least.
